1 Introduction and Acceptance
These Terms and Conditions govern the access and use of educational services provided by Mockstests Private Limited through its official website, authorised mobile applications, online learning platforms, offline teaching centres, social media channels, telephone-based educational services and other authorised communication methods.
By registering for an account, purchasing an educational programme or using the Company's services, users agree to the applicable Terms and Conditions presented to them.
Where a user is a minor, the Company shall obtain parental or lawful guardian authorisation where required by applicable law.
Nothing in these Terms shall exclude or restrict any mandatory statutory rights available to consumers.
2 Educational Services
Mockstests may provide the following services:
- Online and offline teaching programmes, live and recorded classes, academic workshops and educational guidance.
- Online and offline test series, mock examinations, practice questions, assessments and performance reports.
- Free and paid educational content, including study materials, videos, live sessions and educational discussions.
- Telephone-based learning assistance, academic counselling and doubt-resolution sessions.
- Social media learning sessions, educational advertisements, webinars and interactive academic programmes.
- Other educational services introduced by the Company and described through its authorised channels.
The scope, price, duration, eligibility, access period and delivery format of each programme shall be disclosed before enrolment or purchase.
3 User Registration and Account Security
Users may be required to register an account to access selected educational services.
Users shall provide accurate and reasonably necessary registration information and maintain the confidentiality of their login credentials.
Users shall not impersonate another person, create fraudulent accounts or knowingly provide false information to obtain unauthorised access.
Account holders should promptly report suspected unauthorised access to the Company's official support team.
Mockstests shall implement appropriate security measures and shall not make users solely responsible for security incidents attributable to the Company's own acts or omissions.
4 Free and Paid Programmes
Mockstests may offer educational programmes free of charge or against payment of a specified fee.
Free programmes may have different features, access periods or support arrangements from paid programmes, provided these differences are clearly disclosed.
The Company shall not convert a free programme into a paid subscription or impose an additional charge without the user's explicit agreement.
Any optional paid upgrade shall require a separate affirmative purchase decision.
5 Fees, Payments and Invoices
All applicable programme fees shall be displayed before the user confirms a purchase.
The checkout process shall disclose the total payable amount, applicable taxes, mandatory charges and relevant payment terms.
Payments shall be made only through payment methods officially authorised by Mockstests.
Users shall not be required to transfer money to unauthorised personal accounts or third-party payment channels.
The Company shall issue invoices or payment receipts as required by applicable law.
Any recurring subscription or automatic renewal arrangement shall be disclosed clearly and shall require appropriate authorisation.
6 Course Enrolment and Access
Upon successful enrolment and payment, where applicable, users shall receive access to the purchased programme in accordance with its published specifications.
Course details shall identify the applicable commencement date, duration, access period, delivery mode, major learning features and relevant participation requirements.
Where a programme includes both live and recorded content, the availability of recordings shall be governed by the specific terms disclosed before purchase.
Any material change to a purchased programme shall be communicated to affected students, together with available remedies under applicable law.
7 Test Series and Mock Examinations
Students enrolled in a test series shall receive access to the tests, answer keys, explanations, evaluation features and performance reports included in the purchased package.
The Company may establish reasonable examination rules, including time limits, permitted attempts and restrictions against impersonation or cheating.
Such rules shall be disclosed before purchase or participation, as applicable.
Mockstests may review and correct errors in questions, answer keys, explanations or evaluation systems.
Where a material technical failure prevents a student from accessing or completing a purchased test, the Company shall assess an appropriate remedy, including a fresh attempt, restoration of access, extension or refund where applicable.
8 Online and Offline Classes
Students shall follow reasonable academic, attendance and conduct requirements applicable to their enrolled programmes.
Mockstests shall communicate material changes to class schedules, teaching locations, faculty arrangements or programme delivery methods.
Where a material change substantially affects the purchased service, students shall be informed of appropriate alternatives or available remedies.
Offline students shall comply with reasonable classroom safety and conduct requirements.
The Company shall comply with applicable laws governing its physical teaching centres, including relevant safety, accessibility and registration requirements.
9 Telephone-Based Learning and Doubt Resolution
Telephone-based learning sessions may be offered as free or paid services.
The applicable programme description shall specify the service scope, session duration or entitlement, availability, charges and booking or cancellation conditions.
Students shall use the official telephone numbers or communication channels designated by Mockstests.
Teachers and support personnel shall communicate professionally and shall not request unauthorised personal payments or unnecessary sensitive information.
Any recording of telephone sessions shall be governed by the Company's Privacy Policy and applicable law.
10 Social Media Learning and Advertisements
Mockstests may conduct educational activities through authorised social media accounts, including live classes, doubt-resolution sessions, educational discussions, promotional campaigns and free learning programmes.
Users shall not post unlawful, abusive, discriminatory, threatening or otherwise prohibited content through Company-controlled interactive services.
Mockstests may moderate content in accordance with published community rules and applicable law.
Educational advertisements shall accurately describe the relevant programme, fees, duration and material conditions.
The Company shall not make unsupported claims of guaranteed examination success, recruitment, admission or government affiliation.
11 Intellectual Property and Permitted Use
Educational materials developed or lawfully owned by Mockstests, including original test questions, explanations, lectures, videos, graphics, software and course materials, are protected by applicable intellectual property laws.
Students receive a limited, non-exclusive and non-transferable licence to access purchased educational content for their authorised personal educational use during the applicable access period.
Unless expressly permitted, users shall not commercially reproduce, redistribute, resell, publicly upload or unlawfully exploit proprietary educational materials.
Nothing in this clause restricts uses permitted by applicable copyright law or other statutory rights.
12 Prohibited Activities
Users shall not engage in fraudulent transactions, impersonation, unauthorised account access, deliberate disruption of educational services, harassment of students or staff, or unlawful distribution of protected educational content.
Users shall not attempt to compromise the Company's website security or misuse another person's personal information.
Mockstests may take proportionate action against violations, including warnings, restriction of specific features or account suspension.
Where reasonably practicable, affected users shall receive an explanation and an opportunity to seek review.
13 Refund and Cancellation Policy
Refund eligibility shall be determined by the applicable programme-specific terms, the nature and extent of services delivered, the circumstances of cancellation and mandatory consumer protection requirements.
Mockstests shall clearly disclose the refund and cancellation conditions before accepting payment.

A separate, clearly displayed Refund and Cancellation Policy may be incorporated into these Terms and Conditions by reference.
14 Student Conduct and Academic Integrity
Students shall maintain respectful conduct towards teachers, staff and other learners.
Harassment, bullying, discrimination, examination impersonation, fraudulent submission of assignments and deliberate interference with other students' learning are prohibited.
Disciplinary measures shall be proportionate to the nature of the violation and consistent with applicable law.
The Company shall take appropriate steps to protect minors and other vulnerable users from inappropriate conduct.
15 Privacy and Personal Information
Personal information collected through the Company's educational services shall be processed in accordance with its Privacy Policy and applicable law.
Students and parents are encouraged to review the Privacy Policy before providing personal information.
Where additional consent is legally required, acceptance of these Terms alone shall not be treated as a substitute for such consent.
16 Service Availability and Technical Interruptions
Mockstests shall take reasonable measures to maintain the availability of its digital educational services.
Temporary interruptions may occur due to scheduled maintenance, technical failures, internet connectivity problems or circumstances beyond the Company's reasonable control.
Where a material interruption affects a paid service, Mockstests shall consider appropriate remedial measures based on the duration and impact of the interruption.
The Company shall not rely on this clause to exclude liability for deficiencies in service or other liabilities that cannot lawfully be excluded.
17 Account Suspension and Termination
Mockstests may suspend or terminate access where reasonably necessary to address serious violations of these Terms, fraudulent activity, security threats or unlawful conduct.
Except where immediate action is reasonably necessary, the Company shall provide appropriate notice and an opportunity to seek review.
Any refund or restoration of access following suspension or termination shall be assessed in accordance with applicable programme terms and law.
Users may request account closure through the official support or privacy channel, subject to outstanding obligations and applicable data-retention requirements.
18 Limitation of Liability
To the extent permitted by applicable law, Mockstests shall not be responsible for examination outcomes, recruitment decisions or academic results determined independently by external institutions.
Nothing in these Terms shall exclude or restrict liability for fraud, wilful misconduct, negligence, deficiency in services, misleading representations or other liability that cannot legally be excluded.
19 Modification of Terms
Mockstests may update these Terms to reflect changes in its educational services, operational practices or applicable legal requirements.
Material changes shall be communicated through an appropriate official channel.
Changes shall not retrospectively remove accrued contractual rights or materially reduce already purchased services without a lawful basis and appropriate remedy.
Where fresh agreement is required by law, the Company shall obtain it before applying the relevant changes.
20 Governing Law and Dispute Resolution
These Terms shall be governed by the applicable laws of India.
The parties may initially seek to resolve disputes through the Company's grievance redressal mechanism.
Where a dispute remains unresolved, either party may pursue remedies before a competent court, consumer commission, statutory authority or other appropriate forum.
Nothing in these Terms shall restrict the jurisdiction of a consumer commission or any other authority having jurisdiction under applicable law.

ये नियम एवं शर्तें Mockstests Private Limited द्वारा अपनी आधिकारिक वेबसाइट, अधिकृत मोबाइल एप्लिकेशन, ऑनलाइन लर्निंग प्लेटफॉर्म, ऑफलाइन शिक्षण केंद्रों, सोशल मीडिया चैनलों, टेलीफोन-आधारित शैक्षणिक सेवाओं तथा अन्य अधिकृत संचार माध्यमों के जरिए प्रदान की जाने वाली शैक्षणिक सेवाओं तक पहुँच और उनके उपयोग को नियंत्रित करती हैं।
अकाउंट के लिए रजिस्ट्रेशन करने, कोई शैक्षणिक कार्यक्रम खरीदने या कंपनी की सेवाओं का उपयोग करने पर उपयोगकर्ता उनके समक्ष प्रस्तुत लागू नियम एवं शर्तों से सहमत होते हैं।
यदि कोई उपयोगकर्ता नाबालिग है, तो लागू कानून के अनुसार जहाँ आवश्यक होगा, कंपनी माता-पिता या कानूनी अभिभावक की अनुमति प्राप्त करेगी।
इन नियमों की कोई भी शर्त उपभोक्ताओं को उपलब्ध किसी अनिवार्य वैधानिक अधिकार को समाप्त या सीमित नहीं करेगी।
2 शैक्षणिक सेवाएँ
Mockstests निम्नलिखित सेवाएँ प्रदान कर सकती है:
- ऑनलाइन एवं ऑफलाइन शिक्षण कार्यक्रम, लाइव और रिकॉर्डेड कक्षाएँ, शैक्षणिक वर्कशॉप तथा शैक्षणिक मार्गदर्शन।
- ऑनलाइन एवं ऑफलाइन टेस्ट सीरीज़, मॉक परीक्षाएँ, अभ्यास प्रश्न, मूल्यांकन तथा प्रदर्शन रिपोर्ट।
- निःशुल्क एवं सशुल्क शैक्षणिक सामग्री, जिसमें अध्ययन सामग्री, वीडियो, लाइव सेशन और शैक्षणिक चर्चाएँ शामिल हैं।
- टेलीफोन-आधारित लर्निंग सहायता, शैक्षणिक परामर्श तथा डाउट-रिज़ॉल्यूशन सेशन।
- सोशल मीडिया लर्निंग सेशन, शैक्षणिक विज्ञापन, वेबिनार और इंटरैक्टिव शैक्षणिक कार्यक्रम।
- कंपनी द्वारा शुरू की गई और उसके अधिकृत माध्यमों से बताई गई अन्य शैक्षणिक सेवाएँ।
प्रत्येक कार्यक्रम का दायरा, कीमत, अवधि, पात्रता, एक्सेस अवधि तथा उसे उपलब्ध कराने का तरीका नामांकन या खरीदारी से पहले स्पष्ट किया जाएगा।
3 उपयोगकर्ता रजिस्ट्रेशन और अकाउंट सुरक्षा
चुनिंदा शैक्षणिक सेवाओं का उपयोग करने के लिए उपयोगकर्ताओं को अकाउंट रजिस्टर करना पड़ सकता है।
उपयोगकर्ता सही और उचित रूप से आवश्यक रजिस्ट्रेशन जानकारी प्रदान करेंगे तथा अपने लॉगिन क्रेडेंशियल्स की गोपनीयता बनाए रखेंगे।
उपयोगकर्ता किसी अन्य व्यक्ति की पहचान का गलत इस्तेमाल नहीं करेंगे, फर्जी अकाउंट नहीं बनाएंगे और अनधिकृत पहुँच प्राप्त करने के लिए जानबूझकर गलत जानकारी नहीं देंगे।
अकाउंट धारकों को किसी संदिग्ध अनधिकृत पहुँच की सूचना तुरंत कंपनी की आधिकारिक सपोर्ट टीम को देनी चाहिए।
Mockstests उचित सुरक्षा उपाय लागू करेगी और कंपनी के स्वयं के कार्यों या चूक के कारण होने वाली सुरक्षा संबंधी घटनाओं के लिए केवल उपयोगकर्ताओं को जिम्मेदार नहीं ठहराएगी।
4 निःशुल्क और सशुल्क कार्यक्रम
Mockstests शैक्षणिक कार्यक्रम निःशुल्क या निर्धारित शुल्क के भुगतान पर उपलब्ध करा सकती है।
निःशुल्क कार्यक्रमों की सुविधाएँ, एक्सेस अवधि या सहायता व्यवस्था सशुल्क कार्यक्रमों से अलग हो सकती हैं, बशर्ते इन अंतरों की स्पष्ट जानकारी दी गई हो।
कंपनी उपयोगकर्ता की स्पष्ट सहमति के बिना किसी निःशुल्क कार्यक्रम को सशुल्क सब्सक्रिप्शन में परिवर्तित नहीं करेगी और न ही कोई अतिरिक्त शुल्क लगाएगी।
किसी भी वैकल्पिक सशुल्क अपग्रेड के लिए अलग से स्पष्ट खरीद निर्णय आवश्यक होगा।
5 फीस, भुगतान और इनवॉइस
सभी लागू कार्यक्रम शुल्क उपयोगकर्ता द्वारा खरीद की पुष्टि करने से पहले प्रदर्शित किए जाएंगे।
चेकआउट प्रक्रिया में भुगतान की कुल राशि, लागू कर, अनिवार्य शुल्क तथा संबंधित भुगतान शर्तों की जानकारी दी जाएगी।
भुगतान केवल Mockstests द्वारा आधिकारिक रूप से अधिकृत भुगतान माध्यमों से किया जाएगा।
उपयोगकर्ताओं को किसी अनधिकृत व्यक्तिगत खाते या थर्ड-पार्टी भुगतान माध्यम में पैसे ट्रांसफर करने के लिए बाध्य नहीं किया जाएगा।
कंपनी लागू कानून के अनुसार आवश्यक इनवॉइस या भुगतान रसीद जारी करेगी।
किसी भी आवर्ती सब्सक्रिप्शन या ऑटोमैटिक रिन्यूअल व्यवस्था की स्पष्ट जानकारी दी जाएगी तथा उसके लिए उचित अनुमति प्राप्त की जाएगी।
6 कोर्स में नामांकन और एक्सेस
सफल नामांकन और जहाँ लागू हो वहाँ भुगतान के बाद, उपयोगकर्ताओं को प्रकाशित विवरण के अनुसार खरीदे गए कार्यक्रम का एक्सेस दिया जाएगा।
कोर्स के विवरण में लागू प्रारंभ तिथि, अवधि, एक्सेस अवधि, कार्यक्रम उपलब्ध कराने का तरीका, प्रमुख लर्निंग सुविधाएँ तथा संबंधित भागीदारी आवश्यकताओं की जानकारी दी जाएगी।
जहाँ किसी कार्यक्रम में लाइव और रिकॉर्डेड दोनों प्रकार की सामग्री शामिल हो, वहाँ रिकॉर्डिंग की उपलब्धता खरीद से पहले बताई गई विशिष्ट शर्तों के अनुसार होगी।
खरीदे गए कार्यक्रम में किसी महत्वपूर्ण बदलाव की सूचना प्रभावित छात्रों को दी जाएगी तथा लागू कानून के तहत उपलब्ध उपायों की जानकारी भी प्रदान की जाएगी।
7 टेस्ट सीरीज़ और मॉक परीक्षाएँ
टेस्ट सीरीज़ में नामांकित छात्रों को खरीदे गए पैकेज में शामिल टेस्ट, आंसर-की, स्पष्टीकरण, मूल्यांकन सुविधाएँ तथा प्रदर्शन रिपोर्ट उपलब्ध कराई जाएंगी।
कंपनी उचित परीक्षा नियम निर्धारित कर सकती है, जिनमें समय-सीमा, अनुमत प्रयासों की संख्या तथा किसी अन्य व्यक्ति के स्थान पर परीक्षा देने या नकल करने पर प्रतिबंध शामिल हो सकते हैं।
जहाँ लागू हो, ऐसे नियम खरीद या भागीदारी से पहले बताए जाएंगे।
Mockstests प्रश्नों, आंसर-की, स्पष्टीकरण या मूल्यांकन प्रणाली में मौजूद त्रुटियों की समीक्षा कर उन्हें सुधार सकती है।
यदि किसी महत्वपूर्ण तकनीकी समस्या के कारण छात्र खरीदे गए टेस्ट तक पहुँचने या उसे पूरा करने में असमर्थ रहता है, तो कंपनी उचित समाधान का आकलन करेगी। इसमें नया प्रयास, एक्सेस की बहाली, अवधि बढ़ाना या जहाँ लागू हो वहाँ रिफंड शामिल हो सकता है।
8 ऑनलाइन और ऑफलाइन कक्षाएँ
छात्रों को अपने नामांकित कार्यक्रम पर लागू उचित शैक्षणिक, उपस्थिति और आचरण संबंधी आवश्यकताओं का पालन करना होगा।
Mockstests कक्षा की समय-सारणी, शिक्षण स्थान, फैकल्टी व्यवस्था या कार्यक्रम उपलब्ध कराने के तरीके में किसी महत्वपूर्ण बदलाव की सूचना देगी।
यदि कोई महत्वपूर्ण बदलाव खरीदी गई सेवा को पर्याप्त रूप से प्रभावित करता है, तो छात्रों को उचित विकल्प या उपलब्ध उपायों की जानकारी दी जाएगी।
ऑफलाइन छात्रों को कक्षा की उचित सुरक्षा और आचरण संबंधी आवश्यकताओं का पालन करना होगा।
कंपनी अपने भौतिक शिक्षण केंद्रों पर लागू कानूनों का पालन करेगी, जिसमें संबंधित सुरक्षा, पहुँच और रजिस्ट्रेशन संबंधी आवश्यकताएँ शामिल हैं।
9 टेलीफोन-आधारित लर्निंग और डाउट-रिज़ॉल्यूशन
टेलीफोन-आधारित लर्निंग सेशन निःशुल्क या सशुल्क सेवाओं के रूप में उपलब्ध कराए जा सकते हैं।
संबंधित कार्यक्रम के विवरण में सेवा का दायरा, सेशन की अवधि या पात्रता, उपलब्धता, शुल्क तथा बुकिंग या कैंसलेशन की शर्तें बताई जाएंगी।
छात्र केवल Mockstests द्वारा निर्धारित आधिकारिक टेलीफोन नंबर या संचार माध्यमों का उपयोग करेंगे।
शिक्षक और सपोर्ट कर्मचारी पेशेवर तरीके से संवाद करेंगे तथा किसी अनधिकृत व्यक्तिगत भुगतान या अनावश्यक संवेदनशील जानकारी की मांग नहीं करेंगे।
टेलीफोन सेशन की किसी भी रिकॉर्डिंग पर कंपनी की Privacy Policy और लागू कानून के प्रावधान लागू होंगे।
10 सोशल मीडिया लर्निंग और विज्ञापन
Mockstests अधिकृत सोशल मीडिया अकाउंट के माध्यम से शैक्षणिक गतिविधियाँ संचालित कर सकती है, जिनमें लाइव कक्षाएँ, डाउट-रिज़ॉल्यूशन सेशन, शैक्षणिक चर्चाएँ, प्रचार अभियान तथा निःशुल्क लर्निंग कार्यक्रम शामिल हैं।
उपयोगकर्ता कंपनी द्वारा नियंत्रित इंटरैक्टिव सेवाओं के माध्यम से गैर-कानूनी, अपमानजनक, भेदभावपूर्ण, धमकी देने वाली या अन्यथा प्रतिबंधित सामग्री पोस्ट नहीं करेंगे।
Mockstests प्रकाशित कम्युनिटी नियमों और लागू कानून के अनुसार सामग्री को मॉडरेट कर सकती है।
शैक्षणिक विज्ञापनों में संबंधित कार्यक्रम, फीस, अवधि और महत्वपूर्ण शर्तों का सही विवरण दिया जाएगा।
कंपनी परीक्षा में सफलता, भर्ती, प्रवेश या सरकारी संबद्धता की गारंटी से संबंधित ऐसे दावे नहीं करेगी जिनका उचित आधार न हो।
11 बौद्धिक संपदा और अनुमत उपयोग
Mockstests द्वारा विकसित या कानूनी रूप से स्वामित्व वाली शैक्षणिक सामग्री, जिसमें मूल टेस्ट प्रश्न, स्पष्टीकरण, लेक्चर, वीडियो, ग्राफिक्स, सॉफ्टवेयर और कोर्स सामग्री शामिल हैं, लागू बौद्धिक संपदा कानूनों के तहत संरक्षित हैं।
छात्रों को लागू एक्सेस अवधि के दौरान खरीदी गई शैक्षणिक सामग्री को अपने अधिकृत व्यक्तिगत शैक्षणिक उपयोग के लिए इस्तेमाल करने हेतु सीमित, गैर-विशिष्ट और गैर-हस्तांतरणीय लाइसेंस दिया जाता है।
जब तक स्पष्ट रूप से अनुमति न दी गई हो, उपयोगकर्ता कंपनी की स्वामित्व वाली शैक्षणिक सामग्री की व्यावसायिक रूप से नकल, पुनर्वितरण, पुनर्विक्रय, सार्वजनिक अपलोड या गैर-कानूनी उपयोग नहीं करेंगे।
इस खंड की कोई भी बात लागू कॉपीराइट कानून या अन्य वैधानिक अधिकारों द्वारा अनुमत उपयोग को सीमित नहीं करती।
12 प्रतिबंधित गतिविधियाँ
उपयोगकर्ता धोखाधड़ी वाले लेन-देन, किसी अन्य व्यक्ति की पहचान का गलत इस्तेमाल, अकाउंट तक अनधिकृत पहुँच, शैक्षणिक सेवाओं में जानबूझकर बाधा डालने, छात्रों या कर्मचारियों को परेशान करने या संरक्षित शैक्षणिक सामग्री के गैर-कानूनी वितरण जैसी गतिविधियों में शामिल नहीं होंगे।
उपयोगकर्ता कंपनी की वेबसाइट की सुरक्षा से समझौता करने का प्रयास नहीं करेंगे और न ही किसी अन्य व्यक्ति की व्यक्तिगत जानकारी का दुरुपयोग करेंगे।
Mockstests उल्लंघन की स्थिति में उसके अनुपात के अनुसार कार्रवाई कर सकती है, जिसमें चेतावनी, कुछ विशेष सुविधाओं पर प्रतिबंध या अकाउंट सस्पेंड करना शामिल हो सकता है।
जहाँ उचित रूप से संभव होगा, प्रभावित उपयोगकर्ताओं को कार्रवाई का कारण बताया जाएगा और उसकी समीक्षा कराने का अवसर दिया जाएगा।
13 रिफंड एवं कैंसलेशन पॉलिसी
रिफंड की पात्रता संबंधित कार्यक्रम की विशिष्ट शर्तों, प्रदान की गई सेवाओं की प्रकृति और सीमा, कैंसलेशन की परिस्थितियों तथा अनिवार्य उपभोक्ता संरक्षण आवश्यकताओं के आधार पर निर्धारित की जाएगी।
Mockstests भुगतान स्वीकार करने से पहले रिफंड और कैंसलेशन संबंधी शर्तों की स्पष्ट जानकारी देगी।
निम्नलिखित परिस्थितियों का अलग-अलग आकलन किया जाएगा:
- दोहरा या अतिरिक्त भुगतान: सत्यापित अतिरिक्त भुगतान राशि वापस की जाएगी।
- भुगतान कट गया लेकिन नामांकन सफल नहीं हुआ: एक्सेस बहाल किया जाएगा या लागू रिफंड प्रोसेस किया जाएगा।
- Mockstests द्वारा कैंसलेशन: लागू कानून के अनुसार उचित रिफंड या वैकल्पिक व्यवस्था उपलब्ध कराई जाएगी।
- खरीदी गई सेवाओं का महत्वपूर्ण रूप से उपलब्ध न कराया जाना: उचित बहाली, प्रतिस्थापन या रिफंड का आकलन किया जाएगा।
- कार्यक्रम शुरू होने से पहले छात्र द्वारा कैंसलेशन का अनुरोध: संबंधित कार्यक्रम पर लागू कैंसलेशन और रिफंड की शर्तों पर विचार किया जाएगा।
- कार्यक्रम शुरू होने के बाद छात्र द्वारा कैंसलेशन का अनुरोध: रिफंड की पात्रता लागू शर्तों, प्रदान की गई सेवाओं और वैधानिक अधिकारों पर निर्भर करेगी।
- दोषपूर्ण या महत्वपूर्ण रूप से गलत तरीके से प्रस्तुत सेवाएँ: लागू उपभोक्ता कानून के तहत उपलब्ध उपाय अप्रभावित रहेंगे।
स्वीकृत रिफंड को लागू वैधानिक अवधि या संबंधित कार्यक्रम की शर्तों में निर्धारित उससे कम अवधि के भीतर उचित भुगतान माध्यम से प्रोसेस किया जाएगा।
यदि पेमेंट गेटवे या बैंक को अतिरिक्त प्रोसेसिंग समय की आवश्यकता होती है, तो कंपनी छात्र को उपलब्ध ट्रांजैक्शन स्टेटस की जानकारी देगी।
एक अलग और स्पष्ट रूप से प्रदर्शित Refund and Cancellation Policy को संदर्भ के माध्यम से इन नियम एवं शर्तों का हिस्सा बनाया जा सकता है।
14 छात्र आचरण और शैक्षणिक ईमानदारी
छात्र शिक्षकों, कर्मचारियों तथा अन्य विद्यार्थियों के प्रति सम्मानजनक व्यवहार बनाए रखेंगे।
उत्पीड़न, बुलिंग, भेदभाव, किसी अन्य व्यक्ति के स्थान पर परीक्षा देना, असाइनमेंट को धोखाधड़ी से जमा करना तथा जानबूझकर अन्य छात्रों की पढ़ाई में बाधा डालना प्रतिबंधित है।
अनुशासनात्मक कार्रवाई उल्लंघन की प्रकृति के अनुपात में और लागू कानून के अनुरूप होगी।
कंपनी नाबालिगों और अन्य संवेदनशील उपयोगकर्ताओं को अनुचित व्यवहार से बचाने के लिए उचित कदम उठाएगी।
15 गोपनीयता और व्यक्तिगत जानकारी
कंपनी की शैक्षणिक सेवाओं के माध्यम से एकत्र की गई व्यक्तिगत जानकारी को उसकी Privacy Policy तथा लागू कानून के अनुसार संसाधित किया जाएगा।
छात्रों और माता-पिता को व्यक्तिगत जानकारी उपलब्ध कराने से पहले Privacy Policy की समीक्षा करने के लिए प्रोत्साहित किया जाता है।
जहाँ कानून के तहत अतिरिक्त सहमति आवश्यक है, वहाँ केवल इन नियम एवं शर्तों की स्वीकृति को ऐसी सहमति का विकल्प नहीं माना जाएगा।
16 सेवा की उपलब्धता और तकनीकी रुकावटें
Mockstests अपनी डिजिटल शैक्षणिक सेवाओं की उपलब्धता बनाए रखने के लिए उचित उपाय करेगी।
निर्धारित मेंटेनेंस, तकनीकी खराबी, इंटरनेट कनेक्टिविटी की समस्या या कंपनी के उचित नियंत्रण से बाहर की परिस्थितियों के कारण अस्थायी रुकावटें हो सकती हैं।
यदि कोई महत्वपूर्ण रुकावट किसी सशुल्क सेवा को प्रभावित करती है, तो Mockstests रुकावट की अवधि और उसके प्रभाव के आधार पर उचित सुधारात्मक उपायों पर विचार करेगी।
कंपनी इस खंड का उपयोग सेवा में कमी या ऐसी अन्य जिम्मेदारियों से बचने के लिए नहीं करेगी जिन्हें कानूनन समाप्त नहीं किया जा सकता।
17 अकाउंट सस्पेंशन और समाप्ति
इन नियमों के गंभीर उल्लंघन, धोखाधड़ी वाली गतिविधि, सुरक्षा संबंधी खतरे या गैर-कानूनी आचरण से निपटने के लिए जहाँ उचित रूप से आवश्यक हो, Mockstests अकाउंट का एक्सेस सस्पेंड या समाप्त कर सकती है।
जहाँ तत्काल कार्रवाई उचित रूप से आवश्यक न हो, वहाँ कंपनी उचित सूचना देगी और उपयोगकर्ता को समीक्षा का अनुरोध करने का अवसर प्रदान करेगी।
सस्पेंशन या समाप्ति के बाद किसी रिफंड या एक्सेस की बहाली का आकलन संबंधित कार्यक्रम की शर्तों और लागू कानून के अनुसार किया जाएगा।
उपयोगकर्ता लंबित दायित्वों और लागू डेटा-रिटेंशन आवश्यकताओं के अधीन आधिकारिक सपोर्ट या प्राइवेसी चैनल के माध्यम से अपना अकाउंट बंद करने का अनुरोध कर सकते हैं।
18 दायित्व की सीमा
लागू कानून द्वारा अनुमत सीमा तक, Mockstests उन परीक्षा परिणामों, भर्ती संबंधी निर्णयों या शैक्षणिक परिणामों के लिए जिम्मेदार नहीं होगी जिन्हें बाहरी संस्थानों द्वारा स्वतंत्र रूप से निर्धारित किया जाता है।
इन नियमों की कोई भी शर्त धोखाधड़ी, जानबूझकर किए गए कदाचार, लापरवाही, सेवा में कमी, भ्रामक प्रस्तुतीकरण या ऐसी किसी अन्य जिम्मेदारी को समाप्त या सीमित नहीं करेगी जिसे कानूनन समाप्त नहीं किया जा सकता।
19 नियमों में संशोधन
Mockstests अपनी शैक्षणिक सेवाओं, संचालन प्रक्रियाओं या लागू कानूनी आवश्यकताओं में बदलाव को ध्यान में रखते हुए इन नियमों को अपडेट कर सकती है।
महत्वपूर्ण बदलावों की जानकारी उचित आधिकारिक माध्यम से दी जाएगी।
बदलावों के माध्यम से पहले से प्राप्त संविदात्मक अधिकारों को पिछली तारीख से समाप्त नहीं किया जाएगा और न ही बिना किसी वैध कानूनी आधार और उचित समाधान के पहले से खरीदी गई सेवाओं में महत्वपूर्ण कमी की जाएगी।
जहाँ कानून के तहत नई सहमति आवश्यक होगी, कंपनी संबंधित बदलाव लागू करने से पहले ऐसी सहमति प्राप्त करेगी।
20 लागू कानून और विवाद समाधान
ये नियम भारत के लागू कानूनों द्वारा शासित होंगे।
पक्षकार प्रारंभिक रूप से कंपनी की शिकायत निवारण व्यवस्था के माध्यम से विवाद को हल करने का प्रयास कर सकते हैं।
यदि विवाद का समाधान नहीं होता है, तो कोई भी पक्ष सक्षम न्यायालय, उपभोक्ता आयोग, वैधानिक प्राधिकरण या अन्य उचित मंच के समक्ष उपलब्ध कानूनी उपायों का उपयोग कर सकता है।
इन नियमों की कोई भी शर्त लागू कानून के तहत अधिकार रखने वाले किसी उपभोक्ता आयोग या अन्य सक्षम प्राधिकरण के क्षेत्राधिकार को सीमित नहीं करेगी।
